1 Any delivery date quoted by McGill Microwave Systems shall be deemed to be an estimate only and McGill Microwave Systems shall not be under any liability to the Purchaser [You] for late delivery provided that if delivery is not made by the McGill Microwave Systems within 14 days of the quoted delivery date. In any event, delivery times are approximate and variable. When delivery is affected to the Purchaser directly or to an independent delivery contractor as agent for the purchaser, risk shall pass to the buyer immediately.
1.1 McGill Microwave Systems shall be entitled to make delivery by instalments in accordance with any agreed schedule with the Purchaser. Once the schedule has been agreed, the Purchaser shall not be entitled to cancel or vary the schedule for any reason whatsoever unless agreed in writing by McGill Microwave Systems. If the Purchaser wishes to delay or alter any provisions of the schedule, any delay, or alteration must be agreed in writing by the McGill Microwave Systems.
1.2 Unless otherwise agreed in writing by McGill Microwave Systems delivery shall be to the Purchaser at an address of the Purchaser as shown on the purchase order.
1.3 If the Purchaser shall fail to take delivery within seven days of notice by McGill Microwave Systems that the Goods are ready for delivery, the Purchaser shall be liable for extra expense incurred by McGill Microwave Systems as a result thereof including a reasonable charge for the cost of insuring and storing the Goods pending delivery.
1.4 a) All claims for damage to or partial loss of Goods in transit must be made by notice in writing to McGill Microwave Systems within seven days of delivery to the Purchaser or the agent of the Purchaser and any delivery note must be endorsed accordingly on delivery; and b) All claims of non-delivery of the whole consignment or package must be made by notice in writing to the carrier and the McGill Microwave Systems within seven days of receipt by the Purchaser or the agent of the Purchaser of McGill Microwave Systems’ invoice or advice note (whichever is received first): c) In the absence of notification of claims in accordance with the provisions of this Condition the Purchaser shall be deemed to have received the Goods in accordance with the terms of the Contract.
1.5 The rights of the Purchaser under Condition 1 shall constitute the sole and exclusive remedy of the Purchaser for late or non- delivery of the Goods.
1.6 Missing items, occasionally, on orders comprising of multiple parcels, the courier may not deliver the full order all at once. If the balance of the order does not arrive the next day the Purchaser must contact McGill Microwave Systems who will investigate the delay and report any findings to the Purchaser.
1.7 If the Purchaser has a problem with a custom-made product, including a longer delivery time than expected, contact McGill Microwave Systems who will do everything they can to help. However, please remember custom orders cannot be cancelled or returned unless they are faulty.
1.8 Unfortunately, the Purchaser cannot return custom made goods if they no longer want the items. We encourage the Purchaser to contact McGill Microwave directly before placing an online order to obtain specialised product advice and ensure the correct product is provided for their application.
1.9 If a customer would like to return Non-Custom made goods, this is possible. McGill Microwave must be notified within 14 days receipt of the goods and the goods must be delivered within 14 days of notifying McGill Microwave. For returned items, there is a 25% order value re stocking fee to cover Admin Fees, Performance Testing, Inspection and Re Stocking. If products used or damaged, no refund can be processed.
